The introduction of the new immigration law (‘Modern Migratiebeleid’) is being postponed.

The new law was scheduled to enter into force on 1 January 2011. Exactly when the new law will be introduced isn’t hasn’t been announced.

Ernst & Young’s previous alerts in February and July 2010 detailed the forthcoming new immigration law, which was scheduled to enter into force on 1 January 2011. The new law will not change the admittance conditions for foreign nationals. It will, however, reduce the administrative burden and provide accredited sponsors with an independent position.

The Dutch Minister for Immigration and Asylum Policy announced on 12 November 2010 that due to a delay in the implementation of a new IT system at the Dutch Immigration and Naturalisation Services (IND), the introduction of the new immigration law could not take place on 1 January 2011. The new IT system is a prerequisite to the introduction of the new immigration law. Only after it is known how long the implementation of this new IT system at the IND will take, can a decision be made as to when the new immigration law will be introduced. In the meantime, the necessary preparations for the introduction of the new immigration law continue.

Despite the postponement of the new immigration law, organisations with foreign employees must still ensure that their current internal procedures are in compliance on the immigration front.
